Jail and Prison Conditions
Are you or a loved one facing a prison sentence? You are still entitled to your constitutional rights.
These include the right to be free from cruel and unusual punishment. Inmates have the right to humane prison conditions, including the right to adequate food and shelter, medical care, and protection from harm.
Additionally, the Americans with Disabilities Act still applies while an inmate is incarcerated. Jails and prisons must provide equal access for disabled inmates to access prison services and programming. This may mean the jail must provide the inmate medical devices such as a wheelchair, a hearing aid, or an accessible cell that accommodates the inmates’ disability.
Inmates also retain their First Amendment right to access courts, their attorney, and to practice their religion, which may include receiving a diet that conforms with their religious belief or to observe religious holidays and services.
